Leave eligibility rules (maternity, paternity, solo parent, SIL, special leave for women, VAWC)

Which employees the law entitles to each statutory leave, the message you see when a leave isn't allowed, and how an approver can override.

Updated Nov 8, 2026

When leave is filed, by HR or by the employee in the portal, GodoERP checks whether the employee is entitled to it under the law. It checks again when the leave is approved. This comes on top of the usual balance check.

The rules

Leave Who qualifies Law
Service incentive leave (5 days) After 1 year of service Labor Code Art. 95
Maternity leave Female employees. Up to 105 calendar days for a live birth, 120 for a solo parent with a valid Solo Parent ID, 60 for miscarriage or emergency termination. An extra 30 days without pay can be filed separately. RA 11210
Paternity leave (7 days) Married male employees, for the first 4 deliveries of the legitimate spouse RA 8187
Solo parent leave (7 days) At least 6 months of service and a valid Solo Parent ID RA 11861
Special leave for women (up to 2 months) Female employees with at least 6 months of service in the last 12 months, after gynecological surgery. A medical certificate is noted. RA 9710
VAWC leave (10 days) A supporting document is noted: a barangay or court protection order, or a certification from the barangay, prosecutor or court. RA 9262

Other leave types (vacation, sick, company leave) follow only your leave type settings and balance.

What to fill in

On the employee record (HR › Employees › edit):

  • Sex, Date hired and Civil status. Without them, GodoERP asks you to set them first instead of guessing.
  • Solo Parent ID no. and valid until, if any. The ID is valid for one year, so update the date when it's renewed.

On the leave form, extra fields appear for the leave type you choose:

  • Paternity: Which delivery is this? (1st to 4th, or 5th or later).
  • Maternity: Live birth or Miscarriage / emergency termination.
  • Special leave for women and VAWC: Supporting document, for example "Medical certificate dated Nov 3" or "Barangay Protection Order no. 12".

When a leave isn't allowed

The form shows the reason and the law, for example:

  • "Paternity leave covers only the first 4 deliveries (RA 8187). This is delivery no. 5."
  • "Solo parent leave needs at least 6 months of service (RA 11861). On Nov 10, 2026 the employee will have 4."
  • "Maternity leave is up to 105 calendar days for live birth (RA 11210). This request covers 106 days."

Employees who file in the portal see the same reason and are asked to talk to HR.

Approving anyway, with a reason

Sometimes your company policy is more generous than the law, for example a CBA that gives paternity leave for every delivery. A user with payroll approval can still file or approve the leave:

  • On New Leave Request, fill in Override with the reason.
  • On Leave Requests, open Approve with reason under the request.

The reason and who entered it are saved, and the request shows Approved outside the legal rule with the reason. HR staff without payroll approval can't override.

Important: These checks follow the main conditions of each law. They don't replace HR's review of the documents. Ask your adviser about special cases.
